Legal Question in Family Law in New York

What are my legal rights for separation??

I moved out of my marital home 6 months ago. I want to end my marriage and know the way to do that is a separation agreement, a year separated, and then a 'uncontested divorce'. I'm pretty sure my ex will not sign a separation agreement. How do I get divorced??

The one year separation requires either a judgment of separatation or an agreeement. In the absence of either, you must of grounds.

I suggest you consult with an attorney to explore your rights.

You can start the divorce now. You do not have to wait a year. Life is short.

Suggest you consult with an experienced matrimonial attorney.
