Legal Question in Family Law in New York

lying on a divorce settlement

If a party to a divorce settlement -- the father -- states he has a retirement account, but the account has in fact been closed out and no longer exists, what are my options here? And what do I call this infraction -- perjury, fraud or what?

Re: lying on a divorce settlement

You need to find what what happened to the account and when. Suggest you follow the paper trail.

Your attorney should be able to help you with this as part of the discovery process.

If you would like to discuss this with me privately, please call to schedule a confidential consultation.

I practice in NYC and Long Island.
