Legal Question in Family Law in New York

Paternity rights/responsibilities

My 18 year old son has been told by is 17 year old girlfriend that she is 3 months pregnant. This may or may not be his baby. He wants nothing to do w/her or the baby as he has been trying to get out of the relationship for months. Please advise legal rights and responsibilities and if hiring counsel is advisable.

Re: Paternity rights/responsibilities

If the baby is his, he has the responsibility to financially support this child. He does not have to have anything to do with the mother or the child as to contact or visitation but if the child is his, he is required under the law to support the child.

As for retaining counsel, I would recommend retaining counsel, having a consultation to discuss options and a course of action. You need to discuss whether to request a paternity test immediately or wait for the mother of the child to petition for child support and paternity.

If you would like to discuss this matter, you can contact my office at 516.746.4747 or by e-mail at [email protected].
