Your son should contact an attorney immediately. The mother does not have the right to relocate the child without a court order or father's consent. Your son can file a Petition for Custody/Visitation in the Family Court. Keep in mind that the "Home State" of the child is where the child resides for a period of 6 months--So your son should not delay in filing the petition here in New York, otherwise, he will have to bring the action in the state where the child resides.

Feel free to call for a free telephone consulation (646) 587-0188.
