Auto accident no report filed

I was in an auto accident with a vespa. The police was called, but no report was filed. We decided that we would deal with it out of court because the other party told me that it would cost no more than $200 to fix his bike. A few days later, he said that the bill is $900. They told us that we have 10 days to file the report. If the 10th day passes, can the other party still file a report or sue me? he only has 3rd party insurance and i have full coverage. Should i report this to my insurance company or pay him instead?

You can be sued regardless of police report....one thing has nothing to do with another.

The insurance question is a business decision that you will have to make. They will, however, ask why you did not report it earlier (as per the terms of your policy). Of course, you will tell them, based on your comments, that you thought the any damage was so minimal.

But just curious..police came and no report? Odd.
