Legal Question in Civil Litigation in New York

service contract

i have a current service contract with an oil company. my underground oil tank fuel lines clogged and is not covered under the contract. Since it was not cost effective to purchase a new oil tank, i chose to switch to gas heat. now the oil co claims i breeched my contract and wants me to pay for this 5 year contract. did i really breech my contract by not having a oil tank installed at my expence?

Re: service contract

A judge might let you out of the contract due to the unreasonable cost to continue it. Consult an attorney. I might be able to negotiate this down or away for you.

Any attorney answering this question would need to see what the contract says.
