Legal Question in Civil Litigation in New York

No Fault Motor Vehicle Accident

I would like to change the attorney that is representing me for a no fault M.V.A. that occurred last year. Can I do this, and how do I go about it? Thank you.

Your retainer agreement with your current attorney may contain a clause covering notices. If so, comply with that clause by delivering a notice to the attorney, in writing, dismissing him or her...and simply retain your new counsel.

Your old attorney will have a continuing right to payment for work he or she has already done.

Changing attorneys is easy but not always smart

If you really want to change attorneys, it is very easy to do. Just inform your current attorney that you are getting a new attorney and direct him to stop working on the file. You should not do this until after you have found another attorney that will take the case. The old attorney will want to be paid for work done and expenses already incurred. Before you do this though you should think about whether or not you really want to do this. Is it a difference of opinion or is the attorney not doing his job. Call me if you would like to discuss. 5853195334

You can get a new attorney, who will ask you to sign "consent to change attorney" form and take over the case. If you wish to discuss this matter, feel free to e-mail me and/or call my office.
