Legal Question in Civil Litigation in New York

Signed Car loan for My Brother

My brother promised that within 6 months he would have the loan changed into his name. 2 1/2 yrs later I am still getting notices for unpaid parking tickings, he doesnt pay insurance on time and doesn't make car payment on time. I want out of this loan but he does nothing to try to have the car changed into his name. He presently owes over $600 in unpaid tickets and gets an attitude if I approach him. HELP ME!

Re: Signed Car loan for My Brother

In this case he is both heavy and your brother...

You have to get the car back and sell it. Even at a loss. He clearly doesn't want to be the owner of it. He also is ruining your credit rating and taking chances with your license. (Failing to keep your cars insured will cause your license to be suspended.) IF you do not have the guts to repo it yourself, call a lawyer. And next time, learn to say NO. Your not a bank. Under the worst of circumstances get a contract or loan agreement with your brother so you can take some action.
