It would depend on what do you mean by "he isn't a legal citizen of the USA"? What is his status - a permanent resident, on a work visa, illegally? If he is illegally in the USA, when and how did he come to USA - on what visa, if any, and from what country?

The answer(s) depend on a few more facts, including whether he is present in the U.S., and if so, in what status. If he isn't currently present, and you want him to come to the U.S. to marry and reside with you, then you'll be required to petition for a fiance visa. The usual processing time for these would make a July wedding very difficult. Once

If you would like to discuss your situation further, I would be happy to consult with you.

The answer to your question depends on whether you fiance is in USA now, and if yes, in what status and how he initially entered USA. If he is illegal, but entered legally, you can apply for his green card. If there are no other issues, he should get his employment authorization within 3 months after you apply.

If you need assistance, please contact our office for further information.

Good Luck!
