Legal Question in Immigration Law in New York

Parolee Status and H1B

I am the secondary applicant for I-485 (I485 filed through my Spouse who works for a different employer) and I work for a different employer under H1-B status.

My H1B1 is valid till 2007. However, Last year, in 2005 I re-entered US using Advance Parole.

I have never filed for an H1 Extension till now. From the time I was paroled into US (in 2005) till I file my H1 Extension (in 2007), I have continued to work with the same employer who had filed my H1b. Will my work be considered unauthorized? Did I lose my H1B status after I entered as a Parolee? Was i supposed to work using an EAD instead?

Also my I94 card was stamped ''Paroled Until June 2006''. Does this mean I cannot stay beyond this time?

Thank You for your time.

Re: Parolee Status and H1B

Dear Sir,

There are a few issues that you raise in your question that are unclear. Are you saying that you entered the U.S. on an advanced parole while on H-1b? For how many years have you been on H-1b status?

It would be very helpful to review you paperwork to properly analyze your immigration status and future possibilities.
