Legal Question in Immigration Law in New York

Travel & Marriage Question

Hello, I am a U.S. citizen engaged to

a Polish immigrant. He entered the

U.S. legally 9 years ago, but his Visa

has since expired. We live together

in NYC and plan to marry in the next

2 months and then file the proper

forms so he can be legal. My

question is: is it better to marry in

the state we live in (I would prefer to

marry in my home state of California)

and if we did travel to California, can

he travel by airplane without being

caught/deported? He recently

renewed his Polish Passport so it's

current, but he does not have a

current Visa. Thank you for you

help...

It is does not really matter where you get married. Traveling by air with no legal status or U.S. issued ID is always a risk.

For immigration purposes it does not matter where you marry.

Generally, for domestic flight an individual needs to show some kind of ID, like driving license, he is not required to show his passport.
