Legal Question in Insurance Law in New York

My father passed away in New York State in 1984. I recently found an unclaimed life insurance policy from 1960 when he was in the US Army in his name with New York State. His mother, my grandmother was the beneficiary. She passed away in 1992 in NYS.

My mother was married to my father when he passed away. I have filed paperwork with NYS for the unclaimed money and put down my mother's name as spouse and my name as child. Who will get the money? My mother has since remarried and divorced.

I am not an expert in surrogate court matters, but I will try to answer your question as best as I can. You should definitely contact an estates lawyer. It seems to me that the insurance money will be distributed according to your grand mother's will, and the executor should be contacted. If she died without a will, then the court has to appoint an administrator to determine how the money should be distributed to her heirs according to the Laws of the State of New York. Hopefully, there are substantial amounts of money involved that would warrant the effort. I do not believe either you or your mother will get the money outright but would have to fight for it.
