Legal Question in Insurance Law in New York

A tree fell on my car at my apartment, is my landlord responsible?

The other night during a rain storm, a tree limb fell on my car at my apartment house. It is on his property that I park and the tree is located. He says that my auto insurance has to cover it. I and about everyone else I talk to says his homeowners insurance should cover it. Who is right? I have about $1,200 worth of damage to my vehicle.

It depends on many things--but in the first instance, notify your insurance company--it should be a comprehensive type claim.

Generally, no one is responsible for an act of God.
