Legal Question in Employment Law in New York

I am involved in a small actions claim against a defendant. The defendant owes me $900 for a job I and my co-worked completed.

It has been several months since the completion of the job and the defendant has not made any effort to pay me for my services as of yet. Am I allowed to bring him to court and demand more than the $900 which he originally owed me?

I am a freelance filmmaker by profession if that is relevant and no contract was signed and delivered to me, although I have a long list of emails in which the defendant claims to have read and mailed me a copy of my contract (despite me never receiving it.)

If so, on what grounds can I demand more money?

Lateness of payment?

Thanks so much.

Thomas

Locksley Wade Law Office of Locksley O. Wade

This would simply be a breach of contract claim in smalls claim court that would limit your recovery to the amount of the contract and court cost.
