Simple IRA Witholdings not being deposited

Hello, my company offers a simple IRA plan to all of its employees which a predetermined amount is deducted from out paychecks. My employer has not deposited these deductions into our IRA accounts. Is this legal and are there any actions I can take to make him deposit the IRA deductions? Thank you.
