Legal Question in Medical Malpractice in New York

knee surgery malpractice

surgery in november of 1997.Dr. never fixed torn ACL,but verbally confirmed atear and removal of 50%of cartilage posteriorly in knee. Written report only confirms Medial meniscus tear and strong/intact ACL.Go to physical therapy and over time realize knee does not feel well.Return to dr,who then drains knee and injects cortizone and proceedsto tell me that my ''quads are pathetic'' which is why I,m not healing.Struggled for 3years with swelling and pain and now has had confirmed examination and mri of chronic torn Acl along with arthitis. I,m a hairdressor and need legal help.What the statur of limitations ?

I recieved your post on March 19, 2001.

Generally speaking, in NY, the statute is for 2 1/2 years from the date of the act. in malpractice matters. The starting point of this time limit may vary.
