Legal Question in Medical Malpractice in New York

Do I have a malpractice case ?

I was admitted to the hospital on 12/20/06 for lower lumbar surgery. I had been in the same hospital for neck surgery in May of 2006 and had a bad reaction to the morphine I was given and was not supposed to be given this again. The did administer it to me in the recovery room and again I had the same reaction, my blood pressure dropped extremely low and I had to be woken up throught the night to make sure I was ok. The next morning I was woken up by the nurse to try to get me up and walk me as is protocal after this surgery, I didn't feel well at all after trying to walk and asked her to bring me back to my room, I then asked her to put me back in bed as I really wasn't feeling well at all and told her so, she said I had to sit in the chair, and then left me sitting in the room alone. I woke up face down on the floor with blood everywhere. The house doctor was called in and said nothing looks broken.

I now need 4 root canals in my top front teeth, my top teeth have shifted as well and I have a scar on my upper lip and my lower lip is slanted and I cant close my mouth correctly. Do I have enough to sue the hospital ??

The question of whether you can sue versus whether you should sue is very different. As Eric noted in his response there are time limitations that effect your ability to sue with out respect to whether or not you should sue. Whether you sue or not you should contact an attorney that specializes in Medical Malpractice so that you can talk to them about what to do to preserve your rights in the event that you decide it is worth it to you.
