Where can I find settlement information on like cases?

Aloha,

My sister in NY was injured when a vehicle she was standing near, backed into a stack of unsecured pilings in a parking lot. The pilings crushed her foot, and she suffered head injuries. As a result of these head injuries, she has lost her sense of smell and taste. She has an attorney, however, this attorney will not give her any indication of what dollar amount he will be persuing in her case. She feels she is being misled. Where can we find information on settlements of like cases to compare her situation? What would you estimate from this information, her settlement amount would/should be?

I received your post on 6-29-2001.

These matters are extremely complex, as they are not like a broken bone or fracture or run of the mill.

About 15 years ago I was involved in a loss of sense of taste & smell matter where the suit was against a physician and a drug company. But there my client was a chemist.

These cases are very difficult to address because the liability is unusual and the damages are very very fact specific to the occupation and age of the claimant.

Where was the accident?

You indicated that your sister was "in NY", yet the header for the message lists both NY and Hawaii as being states involved. Was this a Hawaii accident? If so, I am located in Hawaii and I would be happy to investigate further on your behalf. If not, I doubt that I could provide much useful information.

I don't think your sister's attorney is trying to mislead her. Even if you find a case exactly like your sisters, which is unlikely, that does not mean she is entitled to that amount. Once a complaint is filed, you will know the amount the attorney is seeking. And the amount sued for is far above what your sister will probably receive.

If your sister still feels like your her attorney is misleading her, she should consider consulting a few other attorneys. She can always fire the attorney she currently has. Once caveat, however. If your sister has had head injuries, it may have affected more than her senses of smell and taste.
