Legal Question in Personal Injury in New York

My wife has been trying to get citizenship for years, she was brought here when she was 2 years old and her parents did nothing to try and get her to become a citizen. Her dad has taught her to drive and I have as well. Recently she took one of my cars to pick up a stranded family member. I didn't give her permission but always leave a spare key at the house in case I lose mine so she can get my mother or sister to bring it to me. Well she decided to pick up a family member that was stranded and unfortunately in the rain she was driving and a guy lost control of his car hit a rock wall and flipped into her forcing her off the road. The accident report states the guy hit her and that she was not at fault but they gave her a ticket for being unlicensed. We are getting the car looked at by the other guys insurance company to be fixed they have not received the police report yet. I just looked at the report and it says she's unlicensed. In new york state are they still liable for paying for my damages? I am getting mixed answers on this and I'm trying to find out the real answer. Also we here there's a way to do special requests to the government on getting her citizenship, she has graduated from high school took some college, paid all her taxes and has never been into any trouble with the law.? Looking for help on these two subjects.

1. Since the other driver caused the accident, the fact she was unlicensed has no relevancy.
