gas lease

I bought a farm in 2002 and just found out yesterday that the land has a gas lease on it that does not expire until 6/2009. The person whom I purchased the farm from is now deceased. I have been told that a gas lease follows the land, but someone has been apparently cashing the royalty checks and keeping them as we have never received any payments since 2002. I believe the executor of the estate has been fraudulently cashing the checks and signing the deceaseds name.What recourse do I have.

you should first check the records in the county clerk's office to see whom is paying the money. You should then contact the gas company's owners and find out how much was paid since 2002 and to whom.

Inform them that you have purchased the land and the gas rights under the land.

you could then bring an action against the executor for cashing the checks.
