property abandonment new york

property was left at my residence back in november of 2005 and contact to the individual was made via telephone and calls were never returned. now nearly two years later i am being brought to small calims court by the residents mother. the resident had moved out suddenly after only residing for approx. 1 1/2 months. the mother never delivered said property and i have stored it ever since.

I'm not sure what question you are asking. Please clarify. Also, did you have a lease? If so, what did the lease provide regarding abandoned property?

Assuming the lease doesn't address this issue, you could seek storage costs but you'd only have a chance at getting them if you gave reasonable notice that they would be assessed. If you're trying to keep the property, then you'd have to have a reasonable reason because it doesn't simply become your property by sitting there long enough.
