Legal Question in Wills and Trusts in New York

Claiming an Inheritance

There are three accounts with the NYS comptrollers office in my aunts name who is deceased.I cannot seem to find any information regarding these accounts. They want death certifacates which I can't get because I am not a direct descendant.I have social security applications from my father and my aunt who are brother and sister. If anyone can help me I would be glad to pay a reasonable fee. I don't know what is in these accounts, but I'll pay what I can.

Re: Claiming an Inheritance

The New York State Comptroller's office will need to be contacted, as well as several other NYS agencies, in order to resolve this estate legal matter. There are several tax, estate, and other legal variables that need to be carefully evaluated. An experienced tax/estate attorney should be able to handle this under NY law. Please note that my legal services are available only with a signed engagement agreement in accordance with the NY Code of Professional Responsibility applicable to attorneys licensed in New York. If I can be of any help to you or people you know, give me a call as I would be pleased to provide legal and tax support. Go to the NY State Comptroller's web site and type in your aunt's name under the category of unclaimed funds. It should show the institution the money came from and the amount.

Re: Claiming an Inheritance

Have you considered applying to be administrator for the estate. If you are the closest living heir, you can qualify. If you explain to the Health Department that the Death Certificate is needed to qualify, they may allow you to obtain one. If not, the Surrogate's Court can assist you. If there was a Will, has it been probated and an Executor qualified. They could obtain the account information. I need more information to properly guide you through this.
