Legal Question in Workers Comp in New York

Fraud

If a person is receiving compensation and is really not as hurt as they portray, meaning they play softball and work but when they go to the doctor or lawyer they can barely walk, what would be the punishment? How do you inform the insurance carrier and what kind of proof would they need to persue the fraud. The same person has a class action lawsuit, would this have the same punishment and procedures. Any help would be greatly appreciated.

The penalties are largely civil (repay all money collected by fraud)

Notify the insurance company paying the worker's comp.
