Legal Question in Workers Comp in New York

Paying Medicare From An Estate?

If Medicare is owed money in a WC case where an employer is found liable, is it possible to postpone paying Medicare by agreeing to pay the money + all interest accrued, and giving them a lien to collect from your estate after you're gone?

Is it Medicare that would come after you, Medicaid, or is Medicare paid by the UEF who should have been primary, and would then seeks to collect from the employer?

Thanks so much for any replies!

Re: Paying Medicare From An Estate?

This is a complicated question one with potential consequences.I believe that the claimant would be reponsible for satisfying any leins on their award. However, If I were you I would obtain a workers compensation attorney and pay him/ her to look over your documents and give you advice.

Please note that if you have already obtained an attorney please ask that attorney.
