Legal Question in Family Law in North Carolina

In a custody case that is still open. Both parties have a signed agreement that the father can see his child every other weeknend Friday at 5m till Sunday at 5pm until they settle. So if the child is not return at the corrected time, can the mother call the police?

Yes, but it is very unlikely that the police will do anything unless the child is missing for a long period. If the father is not returning the child in a timely manner, then the appropriate action would be to file a motion for contempt with the Court. Keep in mind, this is for actions where the father completely disregards the order and shows up whenever he feels like it...not because he is 13 to 30 minutes late...you will do nothing more than annoy the judge that you are there for that.
