Legal Question in Family Law in North Carolina

I gave my baby his fathers last name under the impression we'd be together to raise him as a family. His fathers name is not on the birth certificate. After he turned one month my baby daddy who has been separated from his wife since September 2011 out of the blue decided he wanted to work things out with his wife & go back to her. I wana know if I can change my baby last name to mine without his permission being his name isn't on the birth certificate & I'm his legal guardian. We live in NC.

No. Baby daddy has to consent unless the child is age 16.
