Legal Question in Wills and Trusts in North Carolina

Executor fraud

My father died 1/6/99. Since then I have unsuccessfully been trying to get my brother & sister, the executors, to settle dad's estate. According to dad's will, he left his 10 acres of land to his children. He also left app. $20,000 to cover his expenses. App. 1/2 of this money was used to pay for his funeral and medical expenses--the rest has disappeared. Only my brother wrote checks on the estate account and he's giving no information out to any of us. He has done nothing to settle dad's estate and the taxes keep mounting on the land. I have spoken with the attorney handling the will and he is being somewhat less than helpful also. I have also spoken with the county Clerk of Court but have gotten nowhere. I tried to hire another attorney to help me but no one wants to ''mess with this''. Please tell me what to do next. My brother is telling me nothing and my sister doesn't know anything. Thank you for any help you can give me.

Re: Executor fraud

For heavens sake, try another attorney. Try as many as you need to get one to help you. You will probably have to put some money on the table for an attorney to pick up the ball and do what is needed, but if you don't have any money, some attorneys will go forward for a lein on your share of the estate for their fees. Be persistant. And if at all possible, get a local attorney who deals with estates on a regular basis, because she will know exactly what to do and who to approach. Good luck!
