Legal Question in Bankruptcy in Ohio

Stop the Bankrupcy once it has started

The Trustee that was assigned to me is also the major partner in a law firm that was sueing me, and the company I owned, for money. The Trustee has been verbally abusive and insulting. I want to stop the petition for bankrupcy. I don't care if I get releif from my debts or not at this point. It seems that my attorney is intimidated by the Trustee. How do I stop the petition for bankrupcy?

Why are you giving up so easily? It seems the answer should be to change the trustee, on the grounds of conflict of interest.

The trustee is supposed to be neutral. Ask your lawyer why he or she is not doing anything, and if you are not happy with the answer, turn directly to the bankruptcy judge.

You are also allowed to ask another lawyer for advice - if you can no longer afford a lawyer, try Legal Aid or your local bar association, which probably has a panel of lawyers willing to work for reduced fees.

Good luck!
