phone harrasment on a answering machine

I have been charged with phone harrasment by calling my old girlfriends answering machine.They were not threating calls, just calls trying to get back together. She was not home when I called. She did not call the police until dec 1 but they charged me all the way back to sept,oct,and nov. Since I called a machine when she was not home is it still harrasment?

Telephone harassment - answering machine

If she told you not to call her or call hernumber, any call made after that constitutestelephone harassment. It makes no differencethat you did not talk to your ex-girlfriend.Had you talked with someone else in the house(as opposed to the answering machine), theresult would be the same. Of course, she hasto prove that she told you not to call or tostop calling. If no one was within earshotwhen she told you, she will have a hard timeproving that.
