Caught driving under suspension

My girlfriend is currently under suspension for her 1st dui in six years 3rd total. After spending 10 days in medina county and getting her license suspended, she was caught driving (while on her way to work). The reason she didn't have privlages is because she didn't have time (what with work) to retake her written and driving test (because she is now over 12 points). She is a single mother, she has no family in the area to take her to work. The question we are most concerned with is will she be facing jail time again? Will she get her car back? Or will they just suspend her license for a longer period and give her more fines. This was also the first time she was picked up for driving under suspension. Thank you.

Your girlfriend is in very serious trouble. A substantial Jail sentence (180 days) is possible, and some jail sentence is probable. I do not generally practice in Medina County, but I would strongly urge her to get an attorney in that area ASAP.

Is this Judge Chase? If it is, she simply needs to tell the judge why it happened, and she's probably done enough jail time already...she needs to focus on the positives with the judge, such as, not having been drinking, better direction, good job...things she's done right.
