my girlfriend moved from hawaii with her baby girl. she couldnt take care so the babys father took her to ohio and has had her for 2-3 years. now he wont give her back and says he will fight to keep her. what can she do. we live in las vegas, nv

I assume from the question that your girlfriend was never married to the baby's father and that there was never an order from any Court regarding Custody. If that is true then both parents have equal rights to custody of the baby.

That does not solve your girlfriend's problem. The child and Dad are in Ohio. Dad has indicated that he intends to fight to keep the baby so it is not likely that he is going to allow your girlfriend to have the baby under her control.

Your girlfriend is going to have to come to Ohio and file for custody. The proper court would be the Juvenile Court located in the County where Dad resides.

This will require that she hire and attorney. If you give me more information I can give you a more detailed answer. In any event, I do not recommend that she let the Dad know that she is thinking about doing this until she has talked to an attorney. It is quite possible tha he would get an attorney and file something ahead of her.
