Legal Question in Family Law in Ohio

I need to know

My husband and I are trying to do a dissoultion. Last October he wrote a check against his credit card for $3000. which he put into his checking and spent.Well he is telling me I owe 1/2 of it as it is community debt since we are not divorced! Is that true? Pleae advise...B

If you are doing a dissolution, then you and he can discuss who is responsible for the debt, and incorporate that into your dissolution. A dissolution can only be done if both of you are in agreement about what happens to your assets, liabilities, children, etc. If you are getting a divorce (i.e. neither one of you is in agreement with what the other wants), then, yes, you would both be responsible for the debt. However, if it came to a trial, you might be able to convince a judge that it is wrong to hold you responsible for 1/2 of the debt.
