Legal Question in Civil Litigation in Ohio

I paid a contractor half down to install a concrete driveway and

said he would be here at 7:30 in morning and no show no calls

wont answer the phone. it has been 25 days

he left a backhoe and other equipment in my yard in my way

can not get in my garage

can I file for abandament to remove these items and recover my lost
