two wrong surgerys in the military

i had two shoulder surgerys in the military in 1989,and have had problems since,i went to a ortho surgeon and he stated that the military had performed the wrong type of surgery on my shoulder now my back is messed up and they want to do more surgery.do i have a case?

It depends.

A very important factor is WHEN was the injury discovered. You have one year from the discovery of the injury caused by med.malpractice to file a claim. Another factor is that although the Doctor today can say that the original surgerys were the wrong type, were they the wrong type in 1989?

Lastly, did the medical treatment received in 1989 fall below the standard of care among professional doctors in the area at that time as to be considered negligent?

The answers to the above questions will determine if you have a cause of action.
