Legal Question in Wills and Trusts in Ohio

savings account without P.O.D

My father passed away 4 1/2 years ago and his savings account didn't have a POD. The rest of his assets went to his wife of 4 months. Who is entitled to the savings account and is there a way I can get it without going through her? She was rhe executor of his will but this acoount wasn't in it.

Re: savings account without P.O.D

May I suggest you visit the probate court and view the file. You will see what the will said as well as where that savings account went (unless the account was changed to joint/p.o.d.,or otherwise was a non-probate asset).

Perhaps start by calling the probate court and asking for assistance.

Re: savings account without P.O.D

If the savings account is not specifically mentioned in the will, then it is distributed through any residuary clauses in the will. Chances are, it would go to the wife. It's too late to contest the will, but you must see what it says to see where the money goes.
