Legal Question in Civil Rights Law in Oklahoma

urine drug screening without permission

I recently had a doctor's visit. They asked for a urine sample. I complied then asked what the sample was to be tested for. They told me it was a drug screening test and that I needed to sign papers to authorize this test. I told them I would not sign the papers because I did not feel the test was necessary. They told me in order to see the doctor I must sign the papers. I told them I will not see the doctor than. Then I took my urine sample and dumped it in the restroom toilet and left. Two months later I requested a copy of my medical records. In those records was a note. Stating they they were able to test the cup which I had left in the bathroom. And it came back with positive for marijuana and some other drug that I'm not familiar with. I feel my rights were violated. And now this is in my record. What legal rights do I have.

Re: urine drug screening without permission

This infringement on your rights and privacy can be addressed as a constitutional and civil violation. And, you have every right to pursue the matter in court. All you need is the medical record and proof that you did not give them permission to do so, particularly, if this unsolicited action was made a matter of record.
