Legal Question in Family Law in Oklahoma

Divorce Debts

I have filed for divorce. When I tried to remove my name for our joint checking account, I discovered the bank closed the account because of accumulated insuffient funds on over $1500.00. This does not include the ''hot checks'' that my husband has written. I also, discovered he has not paid any bills, house, car, credit card, payments for the last 3 months. That is when we discussed a divorce. I have given my husband my paychecks every month for the past 20 years. He has always payed the monthly bills. I am presently paying the bills that I can. However, I knew nothing of these ''hot checks'' nor the bank fees. What can, I do? There is no way I can pay all these bills.

Thank you,

RWH

Re: Divorce Debts

The court will determine who pays which debts. It sounds as if you will be able to prove that he had your funds to pay the bills but did not. The "hot checks" written by him after the account was closed will be his problem if the District Attorney decides to prosecute. You should retain an attorney to help you resolve this and with your divorce.
