Legal Question in Family Law in Oregon

I have been separated from my ex husband for approximently 5 years because I can not afford to get divorced. Well I have the opportunity to move to Texas from Oregon & want to take my children ages 13 & 17! Is it legal for me to take them? Are they old enough to make the decision to go with me in a court? I can't get a job here in my professions & have family down there yo support & help me out. They want to go with me as of now but just want to make sure it's ok.

If there is no divorce case yet filed with the court and pending, you are free to move to Texas and take the kids with you. (And he is free to then go to Texas and snatch the kids back.)
