Legal Question in Family Law in Pennsylvania

If you have a baby and are raising it by your self and all of a sudden the father shows up and says I want to see my son, took the baby and walk out, and they told the mother of the baby there is nothing they can do because she never went for custody of the child. Is this true? or is it kidnapping when you have a child unless the father takes you to court you are the one raising the child you have custody, your the Mother, is that right?

Unfrotunately the term"custody" as we understand it is a judically created term. Absent an order by a Court granting some manner of custody, whomever has the child physically is in a better situation.The bottom line is possession really is 9/10s of the law. I would suggest you hurry to Family court and file a petition for custody ensuring that you claim that the father abandoned the child and that you were and are the primary care taker of the child.
