Legal Question in Business Law in Pennsylvania

My wife's job is asking for her full (including the taxes that were taken out) profit sharing check. Can they do that? Do we have options?

The question is why are they doing this. Her profit sharing plan is generally governed by ERISA, a federal law dealing with employee rights with respect to benefit plans. The key document you need is a copy of her company's benefit plan which should spell out the rights available to her concerning the plan. The employer must provide the Plan to her.

What are you talking about? TRY to pose a question that can actually be answered - you give NO explaination. A profit sharing check would be controlled by some agreement. Unless there was some occurance, Was there some error at the company? Was there a litigation? Is is the profit sharing from 2010, or some other year?
