Breeder contract

To Whom it May Concern:

I live in Pgh. Pa and I bought a siberian kitten from a cattery in Austin, Tx. The kitten died at 6mos of FIP. Both vets and other breeders told me not to accept another kitten from her because of this illness.

She offered to replace the kitten, but has no clue when she will breed again. Claims she moved but can't get her address new address PO Box or otherwise, she keeps putting me off about obtaining with every excuse. She even said she mail an agreement letter to me which I haven't received.

Sent a letter to her with vet documents, priority mail receipt guaranteed. Post office claims she received it, she said she didn't. Only communicate with her through email.

I asked for my money (willing to accept $600) the kitten cost $900, and she refused.

Can I submit a small claim if she lives in TX and I in PA? What would be my chances of recovery?

I have a letter signed by our vet stating cause of death.

Was there a written contract? It may tell you where you can sue or file for arbitration. You may want to see if there is a breeds association. If there is you may want to contact them to see if they have some options for you. Otherwise, unless this person does a lot of business with people in PA or has otherwise some who subjected her self to PA law then you would have to sue in Texas.

As for you chances, I do not know anything about this illness. You would have to show that it was the negligence that caused the disease or something that she should have spotted.
