car repairs

I took my car in for repairs at a local dealer. I paid $5,200 for the repairs. Took the car home and two weeks later had to return because car was still not working properly. Was again told that it need a particular part to get it fixed. I said ok, fix it. That was over two months ago. Every week it was something new. But they said I would only have to pay an additional 1,700 for the initial quote. Last week they called to tell me that it was finally fixed, but then the technician took it for a test drive and crashed my car into a tree. Their insurance will only pay us for the book value of the car. Am I entitled to get the $5,200 that I already paid, eventhough they were quessing? If I accept the insurance check, can I then sue them for the cost of the repairs.

Read the insurance settlement closely. It may say something about settling all claims. This should just refer to the damages to the car but the garage may want to try to apply it to the repair claim.

As for suing the garage, I do not know enough of the back ground information to tell if you should sue or not.
