Legal Question in Credit and Debt Law in Pennsylvania

I keep getting contacted by a company that says I am being charged with fraud. They are saying that I took an online loan out in 2009 and the payments were suppose to be taking directly out of my bank account. They have all my info including social security number. The problem is is that I didn't open this bank account that they are talking about until 08/2010. In fact I haven't had a bank account before this one for like 10 years. I keep asking these people to please fax me some paperwork or any kind of documents so i can see what i am dealing with. Their stories differ, the one guy said just plain old no, that there was no paperwork because it was done online and the loan was paperless. Then another man told me that they email papers to me 6 times and i never responded. I told them that I checked my email and never got any of them and asked if they could just resend it or fax it to me and he just basically told me know. I think these guys are trying to scam me for money. They won't really go into any details about whats going on. One guy I talked to said I took the loan out on 3/2/2009, then later that same day another man told me that it was from 12/2009. I then asked them how they got my employers phone number. I informed them that I didn't start this job until 4/10 so obviously my employers number wouldn't be on this "so-called" loan application that i filled out last year. The gentleman then informed me that Citizens Bank ( which is my bank) gave them the number. I already assumed that a bank wouldn't be allowed to divulge that kind of information, but called anyway to check. They told me what I figured that they did not do that. the last guy that I talked to was a supervisor who will not tell me what they want me to do to resolve this matter. He will barely tell me anything. The part that is really upsetting me is that they are calling my boss at work and telling them that I have fraud charges pending and I don't know what else. I can't afford to be fired because they are spreading lies about me. When I asked the supervisor about being told 2 different dates for the loan and about being lied to about where they got my work number, he completely ignored me and just sat in silence until I finally said hello again. When i said again can you answer what I just said to you 2 minutes ago about all these lies i was just told he just said so i guess you don't want to resolve this matter. I told him that I have been on the phone with these people a few times today and anytime I say something they don't like or can't answer they just hang up on me in the middle of the conversation. That is when I got upset and said I felt like this was a scam and that I was going to call the FBI ( I was told by someone that is who you contact in these cases), and asked him for his name. He would not give me his name and said go ahead and call them, you don't have the guts to call the FBI. I said please sir if you could just give me you name and he just kept saying call them now, I will tell them who I am when they get they get on the line. I know this is long basically my question is do you think this really is a scam? I already canceled my direct deposit on my paychecks, but they still have my social social security office. What do you suggest that I do?

Sounds like a payday lender got your information - could be the same name as someone else or someone close to you took out a payday loan in your name. Payday lenders could be anywhere in the world.

Contact the state attorney general. Tell your boss that a payday lender has your info so he will at least know what is going on. There are no fraud charges pending against you and explain this. See if someone at your company can refuse to put these calls through to you.

Do not talk to these people other than to state "my employer does not allow me to receive personal calls at work." Have your boss say the same thing if he calls back again. PA has a law and the attorney general can go after these guys.

Forget the FBI. Its not really a federal action at this point.
