alledged retail theft

I was shopping at wal-mart and picked up some dvd's I thought of getting and later changed my mind and put them back on the shelf. As I'am walkig around I noticed I was being folliwed every where I went, this was strange so I decided to leave. As I'am leaving I seen 3 or 4 of the same ones follow me to my car and as I;am leaving they are taking mw license plate number. Three days larter i get a call from the police asking me if i was at wal mart on that paticular day and was questioned abour tht dvd's and i told them i put them back and they did find them where i put them but clam one is missing so they chaeged me with retail theft. How can they charge me after following me, going to my car and letting me leave with wirh the merchandise if they suspected me of stealig when they should of stoped me leaving the store and searched me for the items instead of letting me leave and call me and say i stoled this and being charged. They do not even have me on survance camera showing me taking anything. Can they do this to me legally?

This is typical Walmart. Yet another reason added to the thousands of others why you shouldn't shop there.

Apparently they insisted that the police file charges. You do need an attorney to defend you from these charges. If you prevail, you may have a suit against Walmart for malicious prosecution.
