Re: Breathalizer

It is enough to hold up in court if...the particular machine was authorized under law, if the machine was properly certified, and the test was conducted properly, and is introduced by an appropriate individual.

However, there is a question as to the reliability and accuracy of these machines that, if you would choose, could be argued. However, this would be an expensive process requiring experts to be hired, etc.

You should speak to an attorney who is well versed in DUI law as soon as possible.

Re: Breathalizer

Yes...if it was properly maintained and calibrated...you better retain a DUI / Criminal attorney ASAP...or face jail time.

Re: Breathalizer

Not only do the police have to have conducted the test properly, it must be introduced into evidence by a properly qualified individual. With the increased penalties under the new DUI law, it is essential to speak to an attorney as soon as possible to discuss all of your possible defenses. I offer free consultations.
