Legal Question in DUI Law in Pennsylvania

my car accident due to debre from a DUI accident

DUI driver drove off of the road into a farmers field, leaving a heavy metal gate and a log laying on the road. My brother-in-law was using my car that night to goto work. On his way home, he was following a white pickup truck, staying about 50 yards behind. When this white pickup truck got close to the DUI accident, a few people standing along the road about 20 yards from the accident flashed a light to warn the truck of the debre on the road. The driver of the truck saw the big gate laying on the road and came to a stop very quickley. My brother-in-law driving my car about 50 yards behind this truck, then past these people on the road. I spoke with one of the people who had flashed the lights, and they informed me that they were talking, and had no time to flash lights at my brother-in-law. So, these people yelled at him passing by to slow down. My brother-in-law looked torwards these people, and looked back at the road to see a truck stopped dead in the middle of the road with no hazzards flashing. My brother-in-law jammed the breaks on, leaving a good 25 feet of black marks on the road before hitting the back of the white pickup truck. The police filed the two accidents separate because the white truck never hit the debree.
