Legal Question in DUI Law in Pennsylvania

dui-- first offense

my boyfriend was charged with a DUI after getting in an accident and totaling his car. His BAC was .157. This is his first DUI charge, although he has had an underage charge. After the accident, he went to a rehabiliation center for alcohol for a five day stay, and continued going to AA classes for about 3 weeks. What can he expect as far as fine, license suspension and/or community service? He also has almost completed an education program and is hoping to teach in an elementary school, what are the chances he would still be able to get a job in PA?

Re: dui-- first offense

Assuming he gets ARD (for first time offenders), his license suspension would be 30 days, plus fine, community service, supervision costs, etc. It differs county to county. Totally up to the DA whether he gets DA.

Different school districts have different policies on hiring people with past ARDs for DUI.

However, ARD is not a conviction, and after completion of the ARD, his record is wiped clean, so therefore, unless specifically asked, he need not reveal it when asked "have you ever been convicted of a crime..."

Re: dui-- first offense

I've been defending DUI matters for 17 years, and I have to tell you that he needs to get a good lawyer on the case ASAP because a lot of things can happen (good and bad) very quickly.

I charge very reasonable fees for first time offenders and will make sure I use every available method to minimize the potential damage he faces in this case. Feel free to contact me to discuss the details.

Mike
