Legal Question in Elder Law in Pennsylvania

Protecting money from the state

Is there anywhere I can put some money that the state cannot take if it should come to pass that my husband goes to a nursing home and we can't pay the whole amount and medicaid has to help?

Can they tough my 401k or IRA

The easy answer first, the Department of Public Welfare does not include your retirement accounts into your husband's eligibility for Medicaid. As for planning around the cost of long term care and having your spouse qualify for mediaid and sheltering items so they can not be taken should your husband go into a nursing home, that is very complex, including laws regarding transfers between spouses, the look back period for transfers and keeping the most money for you, since you will need funds to continue living in the community. It best to figure these things out sooner than later so you can save the most amount of money.
