Legal Question in Environmental Law in Pennsylvania

Water Draining onto my garage

My neighbor recently re-did his gutter system and where before, it drained toward the front it now drains toward my land. I have noticed my garge is noticeably damper and when I mentioned it he said I should waterproof, which I can't afford. Do I have any rights to get anyone to help me pay for waterproofing, or move the drainage away. Thank you.

Re: Water Draining onto my garage

You have several possible avenues of relief: a lawsuit in nuisance is one. This can be expensive and you would need to have a local environmental, real estate or land use attorney look over the situation to estimate fees and the chances of winning. The other route is to consult your township or municipality. There may be ordinances or building codes against re-directing drainage to the detriment of other property, or a way to raise the problem at your town council. A third is to discuss the situation with your neighbor and try to work out a mutually satisfactory resolution before calling in the lawyers or the authorities.
