Legal Question in Family Law in Pennsylvania

Child Name Change/Adoption.

I want to change my 5 year old's last

name. His ''father'' has not seen or

even tried to have any sort of

contact with him since he was 2. I

am now engaged to another man

(we have one son and are expecting

a daughter). I would really love for

my son to have his last name. Would

my fiance be able to adopt him

without us being married? At the

very least can my son's last name be

changed to my fiance's?

Hold off on the adoption till you marry your fiance.

If you don't wait. One of the papers YOU will be signing is a voluntary termination of YOUR parental rights. In addition to having the father's parental rights terminated.

If you wait till you still have terminate the father's rights but even though technically your parental rights are terminated you get them right back. Your plan would leave you with the possibility you'll have no parental rights to your own child.
